Import/Export Compliance Manager
The International Trade & Government Compliance Manager provides the Company with regulatory direction primarily for exports, imports and government contracts, including researching and analyzing information to develop and implement effective compliance policies and procedures. This position applies existing rules and regulations to the Company’s processes to ensure compliance which includes the preparation and submission of required filings and reporting documentation. Balanced communication, interaction, and working relationships with global functional departments, such as law, accounting/finance, procurement, trade compliance, logistics, sales, receiving, quality, engineering, and tax is essential.
Responsibilities include, but are not limited to the following:
65% - Export / Import Compliance:
Research and analyze international and domestic government rules, regulations and related supporting documentation and apply them to Praxair Surface Technologies processes and procedures to ensure Company compliance.
Oversee the Company’s trade compliance Hubs at all domestic and international facilities.
Manage the Company’s written import and export compliance policies and procedures in line with Praxair’s Export and Import Management Programs, including timely updates and other internal controls, to ensure compliance with relevant import and export requirements.
Manage both import and export clearance, including but not limited to proper classification for items under the Harmonized Tariff Schedule (HTS), Schedule B, Commerce Control List (ECCN) and U.S. Munitions List (USML) categories; develop and maintain classification databases; perform deemed export analysis; and maintain required import and export documents.
Conduct restricted party screening and red flag know-your-customer testing.
Monitor and coordinate shipping activities to ensure compliance with all governmental requirements.
Serve as a channel for resolution on compliance issues, including blocking orders/shipments if compliance concerns are not reconciled.
25% - Government Contract Compliance:
Ensure compliance with the Federal Acquisition Regulations (FAR), and related sections of the Defense Federal Acquisition Regulations Supplement (DFARS) so that company can continue to do business with government customers.
Work with leadership and law department to establish company policies and procedures for compliance with FAR/DFARS requirements.
Review government contract clauses for applicability and compliance and representations and certification documentation
Manage the financial and regulatory reporting, prepare government reporting forms, as well as provide oversight of contract compliance as required by contract terms or company policies.
Provide guidance and work with Sales on completing commercial item determinations (CID’s) and supporting cost and price analysis.
Maintain company CAGE codes through SAM.gov and other related government certifications
Interface with government customers or agencies as needed or required.
10% - Other Compliance:
Lead efforts in other government compliance areas such as Foreign Corrupt Practices Act, conflict minerals regulations (Dodd-Frank) and human rights regulations including the California Transparency Act and UK Modern Slavery Act.
Serve as compliance champion on PST’s Compliance Review Board
Prepare advanced training materials that outline the requirements for Company compliance for Hubs and others engaged in import and export or government contract activities.
Conduct internal training on export/import and government contract compliance.
Provide periodic reports to senior management regarding compliance concerns and enhancements.
Audit and evaluate current processes and procedures, prepare and submit required reporting documentation
Perform other responsibilities and duties as assigned.
Bachelor’s degree required; Graduate work and/or other certifications preferred.
7 years’ experience with government regulations (FARS, DFARS, 19 CFR, ITAR, EAR, OFAC, etc.), HTS and ECCN classifications, rules of origin, marking and labeling requirements, import, export and customs compliance, duty drawback. foreign trade zones; and/or equivalent combination of education and experience required
Increased knowledge in the area(s) of government regulations and compliance including, but not limited to, import/export compliance, international logistics, customs documentation, order processing, shipping procedures and government contracting with experience in commercial item determinations.
Ability to identify and describe parts, machines and components in great detail in order to completely and accurately classify parts in accordance with regulations.
Experience with export licensing, technology control plans, ACE, Electronic Export Information filings, SAM.gov and supply chain security programs a plus.
Strong verbal / written communication skills to produce accurate, professional and error-free documents and present information and train personnel at all levels.
Experience in working with a multinational organization in a cross-functional team environment a plus.
Customs Broker License, Certified U.S. Export Compliance Officer® ( CUSECO ), or NCBFAA Certified Import or Export Specialist a plus.
Passport for international travel required.
Travel -Up to 25% domestic and/or international travel by car or plane is required.
Access to export controlled technology/technical data and/or items required to perform this Position are subject to the laws of the United States (including but not limited to the Export Administration Regulations ("EAR"), 15 C.F.R. Parts 730-799, and/or the International Traffic in Arms Regulations ("ITAR"), 22 C.F.R. Part 120-130) and the company's export control procedures, pursuant to which the release of such technology/technical data and/or items to anyone other than a U.S. Person may be considered an export to the person’s home country and may require authorization from the U.S. Government. Thus, additional information in this regard may be required from applicants for this Position.
