Key Objectives/Deliverables:

As counsel for Lilly Value Access, you will join a group of attorneys that provide strategic legal advice and counsel to support the distribution, pricing, access and reimbursement of Lilly’s marketed and developmental products in the U.S. The attorney will work cross‐functionally with therapeutic, medical, Lilly Value and Access, and other specialized attorneys to support various aspects of the development and commercialization of Lilly’s products. The attorney must have a strong working knowledge of fraud and abuse and federal healthcare programs (Medicare, Medicaid, Tricare, etc.) and have provided practical counseling related to the laws and regulations impacting the drug development, promotion, and reimbursement as legal matters may include FDA promotional laws, the intersection between medical and marketing personnel, real world evidence/data, fraud and abuse, and federal healthcare program compliance. The attorney must demonstrate an ability to work collaboratively within Lilly Legal and with leadership in various business functions. In this role, the attorney must have a demonstrated willingness and ability to learn and adapt to be able to provide strategic legal advice to a fast-paced and evolving industry. This position reports to the Senior Director, Lilly Value and Access. Your activities in this role may include the following:

  • Drafting, reviewing, and providing guidance on contracts with payers, pharmacy benefit managers, group purchasing organizations, pharmacies and/or wholesalers, and patient affordability vendors

  • Advising Lilly colleagues, including senior leadership, on the design, implementation, and execution of patient support, affordability, and/or assistance programs.

  • Advising the organization consistent with the Physician Payment Sunshine Act (Open Payments) and corresponding state laws on questions related to the tracking and reporting of Lilly’s financial relationships with HCPs.

  • Providing guidance to Lilly’s Global Business Services and Faculty administration organizations on central capabilities, including governance of Fair Market Value processes.

  • Collaborating with legal and brand colleagues to advise on pricing, reimbursement, and access strategies related to new products.

  • Advising on various government pricing programs for pharmaceuticals, including the Medicaid Drug Rebate Program, the 340B drug discount program, etc.

  • Collaborate with Government Affairs and Public Policy on issues impacting pricing, reimbursement, and access.

  • Review, edit and provide counsel on internal and external communications for compliance with relevant laws, rules, regulations, and internal company policies.

Basic Qualifications

  • Bachelor’s and JD degrees and currently admitted to the bar in at least one U.S. state

  • Candidate must be eligible to be admitted to the bar in Indiana under Indiana Admissions Rules

  • Minimum of 4 years of relevant legal experience either practicing as a member of a law firm in a relevant area of law or practicing in house at a pharmaceutical or biotechnology company’s law department or a combination of the two.

Additional Skills/Preferences

  • Previous experience as a global product attorney and/or at a pharmaceutical or biotechnology company preferred.

  • Knowledge and understanding of pharmaceutical laws and regulations as generally practiced by multinational pharmaceutical manufacturers

  • Experience with anti-kickback statute, competition law, pricing, reimbursement and access issues as they pertain to the pharmaceutical industry

  • Demonstrated leadership and effectiveness in working with senior leadership

  • Highly motivated and collaborative partner with strong interpersonal skills and the ability to work effectively with team members, other lawyers, and members of management across all levels of the company

  • Ability to handle multiple priorities in a dynamic and evolving environment

  • Excellent oral and written communication skills with a shown ability to present complex information accurately and concisely to influence others at all levels of management

  • Strong analytical skills

  • Demonstrated commitment to expand knowledge and adapt to a changing environment

  • Proven learning agility

  • Strong background demonstrating ability to influence people and outcomes

  • Good judgment and a meticulous level of attention to detail
